A Glance at the Tax Laws in Botswana

Botswana does not have social security taxes. However, all employees are required to pay income tax (PAYE). The income tax may change depending on the resident status. You are considered a resident if you are present in the country for more than 183 days in a tax year, regardless of whether you maintain a place of abode in Botswana. For residents, the income tax ranges from 0% to 25% depending on your income. For non-residents, the income tax ranges from 5% to 25% depending on your income.

The Employment Act governs Botswana’s labour laws. The Act establishes rules governing working conditions, termination, and other employment-related matters. Let’s look at some of the employment regulations in Botswana.

  • Working Hours. The standard working week in Botswana is 48 hours, with no more than nine hours worked each day for five days in a week or eight hours for six days in a week. Overtime is compensated at 150% of the regular salary rate. Work done on public holidays or rest days must be compensated at 200% the normal salary rate.
  • Minimum wage. The country has a minimum wage of BWP (Botswana Pula) 7.38 per hour.
  • Employment Contracts. The law does not require you to have a written agreement. However, this is the best practice. The contract should be written in the local language and include details such as the employee’s salary, benefits, and termination requirements.
  • Leave Benefits. All employees are entitled to 15 days of paid time off each year. Female employees are entitled to 12 weeks of partly-paid (usually 50% of their basic salary) maternity leave. However, there is no paternity leave. All employees are entitled to 20 days of paid sick leave per year and must provide a doctor’s certificate to support their absence.
